BT DIGITAL MUSIC AWARDS PRIZE DRAWS
TERMS & CONDITIONS

  1. The Prize Draws are open to GB, Channel Islands and Isle of Man residents other than employees of BT, their families or its agencies.
  2. Under 18s are eligible to enter but must be accompanied by an adult if attending the BT Digital Music Awards, Camden Roundhouse in London at 7pm on the 29 September 2011 (the "Awards"). The Promoter reserves the right to verify the eligibility of entrants and check their identity.
  3. Entries for both the Main Prize Draw and the Golden Poster Daily Draw can be submitted online at www.btdma.com by 11:59pm on the 23 September 2011 as follows:
    (a) Main Prize Draw entry: Entries will be made into the draw every time you (i) submit a vote for every category (one entry per vote); (ii) put up a poster on the BT DMA wall (five entries per poster); (iii) Tweet from this website (five entries per Share); (iv) post from this website to Facebook (five entries per Share); (v) put up a poster on a site in the 'web ring' (one entry per site posted).
    (b) Golden Poster Daily Draw entry: One entry is made into the draw for every poster that is put up on the BT DMA wall once voting in all categories has been completed;
    The above entries can be repeated once a day.
  4. Winners for the Main Prize Draw will be the first 5 entries drawn at random by an independent person on 24 September 2011 ; and winners for the Golden Poster Daily Draw will be randomly drawn each day between (and including) 24 August and 23 September 2011.
  5. All winners will be notified by email on or before 29 September 2011. The Promoter reserves the right to re-draw a winner if they cannot be contacted within a reasonable period of time (to be established at the promoter's sole discretion) and the right to disqualify any entrant or select alternative winner(s) in the event that it believes that any entrant has contravened these Terms and Conditions.
  6. The prizes are as follows:
    (a) Main Prize Draw: 5 x pairs of VIP tickets (table seating and food/drink hospitality included) at the Awards. The first winner selected will also win a white iPad2; and
    (b) Golden Poster Daily Draw: 1 x pair of balcony tickets to the Awards for winner selected daily between and including 24 August and 23 September 2011.
  7. All prizes are subject to availability and do not include any travel, accommodation or other expenses not expressly stated as included.
  8. The Promoter reserves the right to substitute a prize of equal or greater value if this is necessary for reasons beyond its control.
  9. A list of winners (full names only) may be obtained by written request by sending an SAE to Jasmine Holland, pp B6AX, 81 Newgate Street, London, EC1A 7AJ on or before 21 October 2011.
  10. By entering, you agree that your image, biography and likeness (if applicable) may be used by the Promoter in unpaid promotional related publicity (including photographic shots and interviews)
  11. Your personal details will be retained for the purpose of the Prize Draws and will not be processed for any other purpose, unless you choose or have chosen to receive information from the Promoter.
  12. No cash alternative will be offered and prizes are non-transferable.
  13. Submitting an entry to these Prize Draws is deemed to be acceptance by the entrants of these Terms and Conditions. The Promoter reserves the right to alter, amend or foreclose these Prize Draw without prior notice in the event that unforeseen circumstances make this unavoidable.
  14. The Promoter accepts no responsibility for any loss, damage, injury or disappointment suffered by any entrant resulting from entering these Prize Draws or by the entrant's acceptance of the prize, or any damage to any entrant's or other person's computer or mobile phone equipment as a consequence of downloading any material relating to this promotion.
  15. These Prize Draws are governed by the laws of England and Wales.

THE AWARDS TERMS & CONDITIONS

  1. Competition is open to all companies, agencies and artists. Promoter reserves the right to verify the eligibility of entrants and check their identity. Multiple entries are permitted.
  2. Category A ('Judges' choice'): Entries must be made by completing the entry form on the BT Digital Music Awards website www.btdma.com on or before 11:59pm on 15 July 2011 for the following awards: Artist of the Year, Breakthrough Artist of the Year, Best Innovation or Gadget, Best Music App, Best Event, Best Artist Promotion, Best Radio Show or Podcast.

    Category B ('Public voted'): Nominations must be made by completing the nomination form on the BT Digital Music Awards website www.btdma.com on or before 11:59pm on 15 July 2011 for the following awards: Best Place to Discover Music, Best Place to Hear Music, Best Place to Buy Music.

    Category C ('Public voted'): Shortlists will be calculated using independent industry sales data collected up to and including 11:59PM on 2nd July 2011: Best Male Artist, Best Female Artist, Best Group, Best International Artist or Group, Best Independent Artist or Group, Best New Comer, Best Song, Best Video.

    Category D ('People's Choice'): Registrations must be made by completing the registration form on the BT Digital Music Awards website www.btdma.com on or before 11:59pm on 16 September 2011 for the following categories: Best Official Site for an Artist, Best Fan site for an Artist.

  3. 3. 8 shortlists will be selected based on the highest number of industry sales (Category C awards); 3 shortlists will be selected by the independent judging panel in order or merit (Category B awards); 7 shortlists will be selected by the independent judging panel in order of merit (Category A awards); 2 shortlists will be selected being those entrants which receive the highest number of public votes (Category D awards).
  4. 13 final winners will be selected being those entrants which receive the highest number of votes (Category B, C and D awards); 7 final winners will be selected by the judging panel (Category A awards), and each will receive a 2011 BT Digital Music Award.
  5. Winners will be announced at the 2011 Digital Music Awards on 29 September 2011 at tThe Roundhouse, Camden, London and will be presented with their award(s) on the same date. For any winners not present at the ceremony, awards will be delivered within 28 days of postal address being provided.
  6. Winners will be selected in order of merit and will meet a minimum standard of quality. The judges' decision is final and no correspondence will be entered into.
  7. A list of prize winners (name and county only) may be obtained by written request by sending an SAE BT Digital Music Awards, c/o Ballistic Events, Unit 13 Tay Building, 2A Wrentham Avenue, London NW10 3HA, UK on or before 29 October 2011.
  8. By entering this Competition you agree that your image, biography and likeness (if applicable) may be used by the Promoter in unpaid promotional related publicity (including photographic shots and interviews) in connection with the Digital Music Awards if you win.
  9. Your personal details will be retained for the purpose of the Competition Period and will not be processed for any other purpose, unless you choose or have chosen to receive information from the Promoter or Ballistic Events Limited.
  10. The Promoter reserves the right to re-draw the winner if they cannot be contacted within a reasonable period of time (to be established at the promoter's sole discretion) and the right to disqualify any entrant or select alternative winner in the event that it believes that any entrant has contravened these Terms and Conditions.
  11. Submitting an entry to this Competition is deemed to be acceptance by the entrants of these Terms and Conditions. The Promoter reserves the right to alter, amend or foreclose this Competition without prior notice in the event that unforeseen circumstances make this unavoidable.

BT DMA WEBSITE TERMS & CONDITIONS

The BT Digital Music Awards website is provided by British Telecommunications plc (BT) whose registered address is at 81 Newgate Street, London EC1A 7AJ, registration number 4190816.

  1. Applicability and Acceptance

    The following Conditions of Use (the "Conditions") apply to anyone accessing and using the BT Digital Music Awards website at www.btdma.com (the "Site"), entering the BT Digital Music Awards (the "Awards") or entering any competition or prize draw associated with these Awards. Please note that if you choose other services from BT once you have registered with us then you may be asked to accept other applicable terms and conditions.

  2. Applicability and Acceptance

    By using the Site you agree to be bound by these Conditions. BT may modify these Conditions from time to time and you are therefore advised to keep up to date with any changes by regularly reviewing these Conditions.

  3. Eligibility

    3.1 The Site is available to you for your personal use, for entering the Awards or entering any associated competition or prize draw only.

  4. Access to the Site

    4.1 It is your responsibility to ensure that you have an appropriate web browser or any other technical requirements in place in order to access and make use of the Site.

    4.2 In using this Site, you agree to be fully responsible for all activities and for any actions that take place using your name.

  5. Ownership of Content that we provide

    5.1 The content of the Site and the Awards is protected by copyright, trademark and other intellectual property rights as applicable.

    5.2 Except for your content that you have the legitimate right to post or make available on the Site, all content on the Site is owned by BT or licensed to BT by third parties, including information, text, designs, graphics, pictures, video, photographs, applications, software, audio and other files, and their selection and presentation ("Our Content").

    5.3 You must not, without BT's prior written consent, copy, publish, download, de-compile or modify Our Content or use any or part Our Content, unless otherwise agreed in writing by BT.

    5.4 You may download or print a copy of any part of Our Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright, trademarks, logos or other proprietary notices intact. BT reserves the right to withdraw its consent at any time.

  6. User Conduct

    6.1 You agree not to use the Site (or any part of it) to:

    a. act in any way that is unlawful or defamatory, in contravention of any licence, third party rights, or in contravention of any guidance that BT may give to you , and you agree to comply with BT's Acceptable Use Policy which can be found at www.abuse-guidance.com and which may be amended by us from time to time;

    b. damage, disable, overload or affect the operation of the Site;

    c. collect email addresses or other contact information of other users from the Site by any means for the purposes of sending unsolicited emails or other unsolicited communications;

    d. solicit personal information, passwords or other personally identifying information for commercial or unlawful purposes;

    e. register yourself for more than one account, or register on behalf of another individual or group without our written consent;

    f. provide false or misleading information about yourself or your business, or create a false identity; or

    g. use or attempt to use another's account, service or system without BT's prior written authorisation.

    6.2 BT takes any misuse of the Site very seriously indeed, and therefore you agree to take all necessary steps to make sure that you do not misuse the Site. If BT reasonably believes that you have misused the Site (or any part of it) in any way, then BT may terminate your registration, remove your content, and/or suspend or terminate your access to the Site without notice.

    6.3 You agree to indemnify BT against all legal fees, damages and other expenses that we may reasonably incur as a result of any misuse of the Site (or any part of it).

    6.4 If you believe that any content displayed or made available on the Site includes any of the above offences, then please let BT know through our contact page which is displayed on the Site.

  7. Liability

    7.1 BT accepts liability as set out in these Conditions. BT does not guarantee that the Site will be fault-free. 7.2 BT does not exclude or restricts it's liability for death or personal injury caused by BT's negligence or for fraudulent misrepresentation or to any extent not permitted by law.

    7.3 BT has no responsibility to pay you any compensation for financial loss, for any information which is lost or corrupted, or for any loss that could not have been reasonably foreseen (expected) as a result of paragraph 3.

    7.4 BT shall not be liable to you in contract, tort (including negligence), breach of statutory duty or otherwise for any indirect or consequential loss or punitive damages.

    7.5 BT accepts liability in contract, tort (including negligence) breach of statutory duty or otherwise for direct loss limited to £1,000 for all events in any 12 consecutive month period.

    7.6 BT excludes all liability of any kind (including negligence) in respect of any third party product, services, content, or other material made available on, or which can be accessed using, the Site or the validity of the provider of such product, services, content or other materials.

    7.7 Each part of this clause operates separately. If any part of a clause is held by a Court to be unreasonable or inapplicable the rest of the clause shall continue to apply.

  8. Disclaimer of warranties and representations

    8.1 BT excludes any and all warranties or representations whether express or implied, including without limitation any warranties or representations for merchantability, suitability, fitness for a particular purpose, non-infringement of proprietary rights or the accuracy or completeness of third party products, services, content or any other material made available on, or which can be accessed using, the Site, to the fullest extent permitted by law.

  9. Suspension, withdrawal and termination

    9.1 BT reserves the right to suspend or withdraw the Site at any time without notice.

    9.2 BT reserves the right to suspend or terminate any member's registration and use of the Site.

  10. Personal Data

    In addition to our commitments under our Privacy Policy, BT may keep any personal data that you disclose for the purposes of general trend and market analysis. It is your responsibility to ensure that you have the necessary consents if you pass on a third party's email address to BT.

  11. Changes to the Site

    BT reserves the right to modify, edit, delete, suspend or discontinue, temporarily or permanently, without notice, the Site (at any time).

  12. Disputes

    You are solely responsible for your interactions with other BT Digital Music Awards users. BT reserves the right to (but has no obligation to) monitor disputes between you and other users.

  13. Applicable Law

    These Conditions are governed by and will be interpreted in accordance with English Law and any disputes relating to these Conditions will be subject to the exclusive jurisdiction of the English Courts.
